QuickAI ("we," "us," "our") provides an API designed to help businesses and developers automatically moderate user-generated content, fix typos and grammar, and filter inappropriate content on websites.

These Terms constitute a legally binding agreement between you ("you," "your," "user") and QuickAI. By using our Services, you agree to these Terms.

2. Eligibility

2.1. Age Requirement

You must be at least 18 years old or have the legal capacity to enter into a binding contract in your jurisdiction.

By using our Services, you represent and warrant that you are legally able to enter into these Terms and are not prohibited by law from using the Services.

3. Services and Usage

3.1. Service Description

Our API provides the following functionalities:

  • Moderation of user-generated content, evaluating both content and context
  • Automatic correction of typos, grammar, and style issues
  • Filtering inappropriate images

The list above represents our core features but is not exhaustive. We continuously improve our Services and may introduce new functionalities without prior notice.

3.2. Plans and Pricing

  • Free Plan: Limited usage, with up to 100 API calls per month. Once the limit is reached, the service will stop until the start of the next billing cycle or you can upgrade to a paid plan.
  • Paid Plan: Includes 1,000 API calls per month, with additional calls billed during the next subscription cycle. The Paid Plan operates on a pay-as-you-go model.
  • Automatic Renewal: Subscriptions automatically renew each billing cycle unless canceled by the user.
  • Pricing: All prices for the services are available on our pricing page. We reserve the right to change the pricing at any time, but you will be notified of such changes before they take effect.

3.3. Restrictions

You agree not to:

  • Use our Services for any illegal or unauthorized purpose
  • Violate any laws, including intellectual property laws
  • Use the API to harm, defraud, or deceive others
  • Interfere with the integrity or performance of the API
  • Attempt to reverse-engineer or access the source code

4. Payment and Billing

4.1. Payment Processing

All payments for QuickAI are processed by Paddle, which acts as the Merchant of Record. Paddle is responsible for billing-related inquiries, including VAT compliance and refunds. 4.2. Billing and Charges

  • For the Standard Plan, any usage beyond your included quota will be charged in the next subscription cycle. However, if your usage charges significantly exceed your plan's base rate (as determined by our dynamic threshold algorithm), we may process the payment earlier, at the beginning of the month
  • If your payment method fails, access to the Services may be suspended until payment is resolved

4.3. Refund Policy

5. Service Availability and Limitation

5.1. Availability

We strive to provide high uptime and reliability for our Services, but we do not guarantee uninterrupted access. The Services are provided "as is" and we disclaim any warranties or guarantees regarding service availability.

5.2. Disclaimer of Liability

  • We do not guarantee the accuracy, completeness, or effectiveness of the API
  • Our liability for any claims arising from your use of the API will be limited to the amount you have paid for the affected Service during the last 30 days

6. Data Protection and Privacy

6.1. Data Processing

We collect and process minimal personal data necessary for the operation of our Services. For more information on how we handle your data, please refer to our Privacy Policy.

By using our Services, you consent to the collection and processing of your personal data as outlined in the Privacy Policy.

7. Intellectual Property

7.1. Ownership

The intellectual property rights to our service implementation, including our proprietary software, interfaces, and integrations, are owned by QuickAI. However, we utilize third-party services and APIs (including OpenAI) in providing our Services, and these third parties retain all intellectual property rights to their respective technologies, models, and APIs. Nothing in these Terms transfers or assigns any intellectual property rights from these third-party providers to you or to QuickAI.

7.2. License

We grant you a non-exclusive, non-transferable license to use our Services for the purposes specified in these Terms.

7.3. User Feedback

If you provide feedback, suggestions, or improvements ("User Feedback") related to our Services, you agree that we may use such feedback without compensation or obligation.

8. Termination and Suspension

8.1. Termination by You

You may cancel your subscription at any time by following the instructions in your account settings. Upon cancellation, access to the Services will continue until the end of the current billing period.

8.2. Termination by Us

We may suspend or terminate your access to the Services for violations of these Terms, including but not limited to misuse, non-payment, or breach of the restrictions.

9. Governing Law and Disputes

These Terms are governed by the laws of Poland.

9.2. Dispute Resolution

Any disputes related to these Terms will be resolved through negotiation. If the dispute cannot be resolved, it will be settled by arbitration in Poland or, if necessary, by the courts located in the jurisdiction of Poland.

10. Limitation of Liability

To the fullest extent permitted by law, QuickAI will not be liable for any indirect, special, incidental, or consequential damages, including loss of profits, loss of data, or business interruption.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective as soon as they are posted on this page, and we will notify you of any material changes.
